Benjamin Griffiths, Elijah's son, arranged for the conveyance to be copied. Elijah's wife succeeded her husband and lived until 1911.

Conveyance

in exchange of pieces of land at Prenbrigog near Mold in the County of Flint

 

This Indenture made the twenty eighth day of October One thousand nine hundred and fifteen Between Benjamin Griffiths late of Prenbrigog near Mold in the County of Flint but now of Padeswood near Mold aforesaid miner of the one part and Robert Jones of Prenbrigog near Mold aforesaid farmer of the other part Whereas the said Benjamin Griffiths is entitled in fee simple free from incumbrances to the garden land and houses now erected thereon which garden land and houses are coloured blue on the plan hereto annexed and the said Robert Jones (as part of a larger field piece or parcel of land) is entitled in fee simple free from incumbrances to the land coloured pink on the said plan which adjoins the land of the said Benjamin Griffiths And whereas the said Benjamin Griffiths and Robert Jones have agreed as follows the said Benjamin Griffiths to grant to the said Robert Jones his heirs and assigns a right of road ten feet wide through over and along the said gardens land on the extreme East thereof which the said right of way is coloured yellow on the said plan in exchange for the said piece of land belonging to the said Robert Jones and coloured pink on the said plan to be conveyed to the said Benjamin Griffiths Now this Indenture witnesseth that in pursuance of the said agreement and in consideration of the conveyances in exchange hereinafter made by the said Robert Jones and of the premises the said Benjamin Griffiths as beneficial owner doth hereby grant unto the said Robert Jones his heirs and assigns Full and free right of way for all purposes in common with the said Benjamin Griffiths and his tenants and servants and with or without carriages carts or wagons and with or without horses or engines over and along all that strip piece or parcel of land ten feet wide coloured yellow on the said plan between A and B on the said plan Together with the right to have and maintain for the exclusive use of the said Robert Jones his heirs and assigns and his and their tenants a gate at the end of the said way at the mark B in the said plan To hold the same unto and to the use of the said Robert Jones his heirs and assigns And the said Robert Jones in pursuance of the said agreement and in consideration of such conveyance in exchange as aforesaid made by the said Benjamin Griffiths as beneficial owner hereby grants unto the said Benjamin Griffiths All that piece or parcel of land containing one hundred and ninety eight square yards or thereabouts and edged pink on the said plan hereto annexed To hold the same unto and to the use of the said Benjamin Griffiths his heirs and assigns And it is agreed and the said Robert Jones covenants with the said Benjamin Griffiths that he will erect and maintain a suitable fence on the West side of the said strip of land A - B And the said Benjamin Griffiths covenants with the said Robert Jones that he will erect and maintain a suitable fence on the North and East sides of the said piece of land coloured pink between the points E and C and C and D on the said plan In witness whereof the said parties to these present have hereto set their hands and seals the day and year first before written.
